جامع نوٹ: نکاحِ متعہ پر شرعی فیصلہ

بسم اللہ الرحمٰن الرحیم
اسلام نے نکاح کو مستقل،باعزت اور شرعی ضابطوں کے مطابق تعلق کا ذریعہ قرار دیا ہے۔ ابتدائے اسلام میں بعض وقتی مجبوریوں کے باعث عارضی طور پر نکاحِ متعہ کی اجازت دی گئی تھی،مگر بعد میں رسول اللہ صلی اللہ علیہ وسلم نے اس پر ہمیشہ کے لیے پابندی عائد فرما دی۔
نکاحِ متعہ ایسا وقتی معاہدہ ہے جس میں مخصوص مدت کے عوض مرد و عورت جنسی تعلق قائم کرتے ہیں، اور مدت پوری ہوتے ہی نکاح از خود ختم ہو جاتا ہے۔
قرآن و حدیث اور اجماعِ امت کی روشنی میں حکم
1. رسول اللہ صلی اللہ علیہ وسلم کا فرمان:
> "خیبر کے دن نبی کریم صلی اللہ علیہ وسلم نے نکاحِ متعہ اور پالتو گدھوں کا گوشت حرام فرما دیا۔"
(صحیح مسلم: 1407)

خود نکاح کرنے سے پہلے دینی عالم سے مشورہ ضرور کر لینا چاہیے۔
رجسٹریشن کروا لینا بھی ضروری ہے۔

دعا ہے کہ اللہ تعالیٰ ہمارے نکاح، گھرانے اور معاشرے کو پاکیزہ اور پرامن رکھے۔ آمین۔

لیکن یاد رہے کہ لڑکی کے ولی کی اجازت کے بغیر جمہور علما کے نزدیک یہ نکاح جائز نہیں۔

ولی کی اجازت کیوں ضروری ہے؟
حدیث رسول ﷺ:
"لا نکاح إلا بولي وشاهدي عدل"
(سنن ابوداؤد، حدیث: 2085)
ترجمہ: ولی اور دو عادل گواہوں کے بغیر نکاح نہیں ہوتا۔
ولی کی اجازت نکاح کے تحفظ اور برکت کے لیے ضروری ہے، تاکہ معاشرتی، قانونی اور خاندانی مسائل نہ پیدا ہوں۔

نکاح کے بعد رجسٹریشن
نکاح کے بعد نکاح نامہ کی رجسٹریشن ضروری ہے تاکہ قانونی تحفظ حاصل ہو اور بعد کے معاملات میں آسانی ہو۔
خلاصہ
نکاح کے لیے مولوی کا ہونا شرعاً ضروری نہیں، لیکن بہتر ہے۔
نکاح کی شرائط:
1. لڑکا، لڑکی کی رضامندی
2. ولی کی اجازت
3. دو گواہ

4. مہر کی تعیین
مہر نکاح کا حق ہے، جس کا تعین نکاح کے وقت کیا جاتا ہے۔
کیا مولوی کا ہونا ضروری ہے؟
شریعت میں نکاح کے لیے مولوی صاحب (عالم دین) کا ہونا ضروری نہیں۔ نکاح اگر شرعی شرائط کے ساتھ لڑکا اور لڑکی اپنی رضامندی سے، ولی کی اجازت سے، دو گواہوں کی موجودگی میں مہر کے ساتھ کر لیں، تو نکاح درست ہو جاتا ہے، چاہے اسے مولوی صاحب پڑھائیں یا کوئی اور۔
لیکن چونکہ عام لوگ نکاح کے الفاظ، شرائط اور مسائل کا مکمل علم نہیں رکھتے، اس لیے دینی عالم یا نکاح رجسٹرار کی موجودگی میں نکاح کرنا بہتر اور مستحب ہے، تاکہ کوئی شرعی غلطی نہ ہو۔
خود نکاح کرنے کا طریقہ
اگر نکاح تمام شرائط کے ساتھ گھر میں یا کسی جگہ کرنا ہو تو طریقہ یہ ہے:
لڑکا کہے:
"میں تم سے اتنے مہر کے بدلے نکاح کرتا ہوں"
لڑکی کہے:
"میں نے قبول کیا"

اسلام نے نکاح کو ایک باعزت،بابرکت اور سادہ عمل بنایا ہے۔نکاح کے لیے مولوی صاحب کا ہونا شرعاً لازم نہیں،لیکن نکاح کی شرائط اور آداب کا پورا جاننا ضروری ہے تاکہ کوئی کمی،غلطی یا گناہ نہ ہو۔اس کتابچہ میں اسی سوال کا آسان اور واضح جواب پیش کیا جا رہا ہے کہ کیا بغیر مولوی کے نکاح ہو سکتا ہے؟ اور اس کا صحیح طریقہ کیا ہے؟
نکاح کی شرائط
1. لڑکا اور لڑکی کی رضامندی
نکاح میں دونوں فریقین کی مکمل رضامندی ضروری ہے۔
2. ولی کی اجازت (لڑکی کے لیے)
شریعت میں لڑکی کا نکاح اس کے ولی (والد، دادا، بھائی وغیرہ) کی اجازت کے بغیر درست نہیں۔
3. دو عاقل،بالغ،مسلمان مرد گواہ
نکاح کے وقت کم از کم دو گواہوں کا موجود ہونا شرط ہے۔

3.2. Sayyiduna Ali (may Allah be pleased with him) said:
"Whoever saw him was immediately awestruck, and whoever spoke to him instantly fell in love with him."
[Shama'il Tirmidhi]
Conclusion
The words of the Prophet Muhammad (Peace and Blessings Be Upon Him) are beautiful because:
They were illuminated with Divine revelation, filled with truth, love, and wisdom.
They contained mercy, tenderness, and an incomparable ability to touch hearts.
They emerged from the depth of a pure and sincere heart, reaching deep into others.
They were spoken gently, with a smile, and in a graceful, dignified manner.
They were brief, yet profound, always carrying deep meaning and wisdom.

The Prophet (Peace Be Upon Him) said:
"Indeed, some forms of eloquence have the effect of magic."
[Sahih al-Bukhari: 5146]
And the most impactful and captivating speech was undoubtedly that of the Prophet Muhammad (Peace Be Upon Him).
3. Companions’ Testimony About His Character and Words
3.1. Sayyiduna Anas (may Allah be pleased with him) said:
"I served the Messenger of Allah (Peace Be Upon Him) for ten years. Not once did he say 'Uff' to me, nor did he ever scold me, nor did he ever ask me why I did something or why I did not."
[Sahih Muslim: 2309]
Such gentleness, compassion, and kindness in speech is unparalleled.

"I have never seen anyone who smiled more than the Messenger of Allah (Peace Be Upon Him)."
[Jami’ at-Tirmidhi: 3641]
This means his conversations were always filled with affection, compassion, and a welcoming smile, making them soothing to the heart.
2.3. Truth Delivered with Gentleness
The Prophet (Peace Be Upon Him) said:
"Gentleness is not found in anything except that it beautifies it, and it is not removed from anything except that it makes it defective."
[Sahih Muslim: 2594]
The Prophet’s every word was the truth, yet always expressed with gentleness, moral grace, and mercy.
2.4. Brief Yet Wise Speech
Another characteristic of his blessed conversation was its brevity, yet rich in wisdom, depth, and care.

"So by mercy from Allah, you were gentle with them. And if you had been rude and harsh hearted, they would have dispersed from around you."
[Surah Aal-e-Imran: 159]
This is why the words of the Prophet (Peace Be Upon Him) would reach deep into the hearts of people, making them willing to sacrifice their lives for him.
2. The Beauty of the Prophet’s (Peace Be Upon Him) Words in Hadith
2.1. Soft, Clear, and Comprehensive Speech
Sayyidah Aisha (may Allah be pleased with her) said:
"The Messenger of Allah (Peace Be Upon Him) did not speak rapidly as you do, but his speech was clear, distinct, and soft."
[Jami’ at-Tirmidhi: 3639]
2.2. Speaking with a Smile
Sayyiduna Abdullah bin Harith (may Allah be pleased with him) narrated:

"And indeed, you (O Prophet) are of a great moral character."
[Surah Al-Qalam: 4]
This means that every word, action, attitude, and behavior of the Prophet (Peace Be Upon Him) was a perfect example of noble conduct, kindness, and love.
1.2. A Mercy to the Worlds
Allah declares:
وَمَا أَرْسَلْنَاكَ إِلَّا رَحْمَةً لِّلْعَالَمِينَ
"And We have not sent you (O Muhammad) but as a mercy to the worlds."
[Surah Al-Anbiya: 107]
Even in his advice, warnings, and admonitions, the Prophet (Peace Be Upon Him) was an embodiment of mercy and goodwill.
1.3. Kind-Hearted and Gentle Nature
Allah mentions:
فَبِمَا رَحْمَةٍ مِّنَ اللَّهِ لِنتَ لَهُمْ ۖ وَلَوْ كُنتَ فَظًّا غَلِيظَ الْقَلْبِ لَانفَضُّوا مِنْ حَوْلِكَ

The Beauty and Grace of the Words of the Prophet Muhammad (Peace and Blessings Be Upon Him) in the Light of the Qur’an and Hadith

Introduction
I will explain in detail, through the light of the Qur’an and Hadith, why the words of the Prophet Muhammad (Peace and Blessings Be Upon Him) are so beautiful, loving, and captivating, and what an exalted and graceful status his blessed personality possesses.
1. The Magnificence of the Prophet (Peace Be Upon Him) in the Qur’an
1.1. Exalted Character
Allah Almighty says:
وَإِنَّكَ لَعَلَىٰ خُلُقٍ عَظِيمٍ

آنحضرت محمد صلی اللّٰہ علیہ وآلہ وسلم کی باتیں اتنی پیاری ہیں اور سوچو وہ خود کتنے پیارے ہونگے؟

Thus, a heart devoid of God's remembrance is a dead one. Advising such a soul is futile unless they willingly seek to awaken.
Conclusion:
This reflection teaches us that giving counsel and preaching wisdom is the way of the Prophets and the righteous, but its effect is only upon those whose hearts are open to it. The Qur'an, Hadith, Bible, Torah, and Psalms collectively convey this message — advice benefits only those willing to listen and act.
For the stubborn, arrogant, and heedless, truth and wisdom are like playing a flute before a buffalo a beautiful effort, but utterly fruitless.

For such individuals, it is rightly said that not only have we played a flute before a snake, but we have also tried to charm a buffalo with it.
Symbolism Explained:
A snake is a naturally hostile creature, while a buffalo is characteristically dull and insensitive. Expecting good from either is unrealistic. Similarly, a person devoid of conscience and heart, despite hearing the most eloquent words of truth, remains unaffected unless they themselves seek guidance.
Prophetic Wisdom:
The Prophet Muhammad (peace and blessings be upon him) beautifully illustrated this reality:
> "The example of the one who remembers his Lord and the one who does not is like the living and the dead."
(Sahih al-Bukhari: 6407)

Example of Prophet Nuh’s People:
The Qur'an mentions the people of Prophet Nuh (Noah, peace be upon him):
> "And indeed, whenever I invited them so that You might forgive them, they thrust their fingers into their ears."
(Surah Nuh: 7)
Biblical and Torah References:
A similar condition prevailed during the time of Prophet Jesus (peace be upon him). In the Bible (New Testament), it is recorded:
> "He who has ears to hear, let him hear."
(Matthew 11:15)
But despite this call, many remained blind and deaf to guidance.
The Torah also mentions such obstinate people:
> "But they refused to pay attention; stubbornly they turned their backs and covered their ears."
(Zechariah 7:11)
